Wills and Trusts
A properly constructed estate plan codifies your decisions regarding the distribution of your property, and the identity of your beneficiaries. Wills and trusts are two main components of any comprehensive estate plan. A will is a document in which you identify your property to the court, and detail how you want that property to be distributed. Wills also permit you to appoint a guardian for loved ones and grant someone a power of attorney. A trust, in contrast, is a way for you to remain in control of your property during your life, while avoiding probate and certain estate taxes upon your death.
Powers of Attorney
Since Texas does not recognize same-sex relationships, it may be necessary to draft a power of attorney, as it allows your partner to make decisions for you in the event you become incapacitated. You can grant a medical, financial, or general power of attorney to a loved one, which allows them to make decisions about your medical treatments, finances, and other personal issues. However, if you fail to grant someone this power of attorney, the State will decide for you.
